Privacy Notice on the Processing of Personal Data
At Marvas Legal we attach importance to privacy and to the protection of personal data.
As data controller, Marvas Legal would like to inform you about the processing of your personal data under Law No. 6698 on the Protection of Personal Data (the “Law”) and related legislation.
Separate privacy notices have been prepared for the purposes and scope of processing carried out through the forms in the relevant sections of our website. We also maintain separate notices for our employees, job applicants and interns, and for visitors to our office.
By means of this notice we wish to provide information about the personal data of website visitors, business partners, clients and prospective clients processed in the course of our activities.
What Personal Data Do We Process, For What Purposes and On What Legal Basis?
Website Visitors
We process the IP addresses of visitors to our website in order to classify and evaluate user data, for website analytics and improvements, and to understand how the features and functions of the site are used so as to improve the user experience. The legal basis is Article 5/2 (f) of the Law: processing being necessary for the protection of our legitimate interests, provided that it does not harm your fundamental rights and freedoms.
Our website also contains links to some of our social media accounts. By clicking the symbols of the relevant social media providers you may access those accounts separately. Those social networks may collect and process your personal data independently. We have no control over the data collected or the processing carried out. If you access those social media accounts, we recommend that you review the privacy notices and terms of use published by the relevant providers.
Even if you share no information with us through our website or other communication channels, you may consult our cookie policy for other data that may be obtained during your visit. We can state at the outset that, under our cookie policy, only a very limited number of cookie types are used, for the purpose of meeting your needs during your visit and for analytics. During your visit information such as the language of your browser, your time zone, the time spent on our pages and search engine optimisation data is obtained; through the tools we use, information about visits to our site is shared with us in anonymous and aggregate form (such as how many visitors from which country). Our Clients
The personal data of our clients, or of the representatives, officers or employees of our corporate clients, is processed within the framework of the advisory services or litigation we conduct, for the purposes of providing services to and representing our clients, in the context of establishing a power of attorney relationship or concluding a service agreement and performing our duties. The legal basis is Article 5/2 (c) of the Law: processing being directly related to the establishment or performance of a contract.
In addition, the personal data of our clients, or of the representatives, officers or employees of our corporate clients, is processed for the purposes of managing our business relationships, communicating with them and keeping them informed of legal developments, on the basis of Article 5/2 (f) of the Law: processing being necessary for the protection of our legitimate interests, provided that it does not harm your fundamental rights and freedoms.
Our Business Partners
The personal data of our business partners and suppliers, or of the representatives, officers or employees of our corporate business partners and suppliers, is processed for the purposes of concluding and performing contracts, on the basis of Article 5/2 (c) of the Law: processing being directly related to the establishment or performance of a contract. Personal data is further processed for the purposes of managing our relationships with business partners and suppliers, communicating with them and keeping them informed of legal developments, on the basis of Article 5/2 (f): processing being necessary for the protection of our legitimate interests.
Prospective Clients and Stakeholders
The personal data of prospective clients requesting a proposal from us, of the representatives, officers or employees of prospective corporate clients, of individuals we meet at events or whose data we lawfully obtain from publicly available sources, and of our stakeholders, academics and colleagues, is processed for contact management within the software used by Marvas Legal, for communicating with these persons and for keeping them informed of legal developments and events. The legal basis is Article 5/2 (f) of the Law: processing being necessary for the protection of our legitimate interests, provided that it does not harm fundamental rights and freedoms.
In addition, the personal data of our website visitors, clients, business partners, prospective clients and stakeholders may be disclosed to official authorities without your explicit consent where duly requested by those authorities in accordance with the relevant legislation, and in cases where disclosure to official authorities is mandatory under applicable imperative provisions. The personal data of our website visitors, clients, business partners, prospective clients and stakeholders may also be used to the extent necessary in connection with an actual or potential legal dispute affecting Marvas Legal, and shared with courts and other competent authorities. In this context personal data may be processed without your explicit consent under Article 5/2 (ç) of the Law, for the purpose of fulfilling Marvas Legal’s legal obligations, and under Article 5/2 (e), for the establishment or protection of Marvas Legal’s rights.
To Whom and For What Purposes May We Transfer Your Personal Data?
Only where necessary to fulfil the processing purposes set out above, the personal data you transmit to Marvas Legal or that we obtain may be shared with third-party firms in Türkiye from which we receive services, support or consultancy, and with authorised public institutions and organisations, within the scope of the purposes described above.
Your personal data may be shared with authorities empowered to request your information under the legislation, and with competent authorities in the event of disputes.
Our computer systems and infrastructure are held in Türkiye, and as a rule your personal data is not transferred abroad.
By What Methods Do We Collect Your Personal Data?
Your personal data is collected through the documents and information you transmit to us electronically or physically, verbally, in writing or electronically, by automated and non-automated means.
What Are Your Rights Regarding Your Personal Data?
We would remind you that under Article 11 of the Law you have the following rights:
- To learn whether your personal data is processed and to request information if it has been processed,
- To learn the purpose of processing and whether the data is used in accordance with that purpose,
- To know the third parties to whom your personal data has been transferred,
- To request rectification where your personal data has been processed incompletely or inaccurately, and, where you exercise this right, to request that this be notified to the third parties to whom the data has been transferred,
- To request erasure or destruction of your personal data where the grounds for processing have ceased to exist, and, where you exercise this right, to request that this be notified to the third parties to whom the data has been transferred,
- To object to a result arising against you from analysis of the information obtained by automated systems, and to claim compensation should you suffer loss.
