Amendments to Turkish Data Protection Law No. 6698

The Law Amending the Code of Criminal Procedure and Certain Laws amended Articles 6, 9 and 18 of Law No. 6698. The amendments entered into force on 1 June 2024; the transition period for international transfers ran until 1 September 2024.

The Law Amending the Code of Criminal Procedure and Certain Laws, which also contains provisions concerning Law No. 6698 on the Protection of Personal Data, was published in the Official Gazette dated 12 March 2024, issue 32487.

Articles 33 to 36 of that Law amend Articles 6, 9 and 18 of Law No. 6698 and add a new provisional article to it.

The amendments entered into force on 1 June 2024. However, the existing first paragraph of Article 9, which governs the procedures and principles for transferring personal data abroad, continued to apply alongside the amended version of the article until 1 September 2024.

Data controllers and data processors accordingly needed to carry out their preparatory work carefully and without delay in order to align with the new provisions during that transition.
